About these terms

TopChoice ("we", "us", "our") is operated by EightySix Digital. These terms apply when you use the site and when you buy a TopChoice Spotlight placement. If you buy a placement, you are agreeing to them.

How we handle personal information is covered separately in our Privacy & Disclaimer, along with the editorial disclaimer that applies to our rankings.

Using TopChoice

TopChoice is an independent editorial directory. Our Top 5 lists reflect our opinion based on publicly available information, and they are a starting point rather than the sole basis for choosing a provider. You deal directly with the businesses listed, and we are not a party to any agreement between you and them. The editorial disclaimer sets this out in full.

TopChoice Spotlight placements

A Spotlight placement is a paid, clearly labelled sponsored position above the editorial Top 5 on one trade and location page.

What you get

• One sponsored card above the Top 5 on the page you bought, labelled as Sponsored, with buttons to call you or open your website.
• One Spotlight business per category, per location. While your placement is live, nobody else can hold that spot.
• Your placement starts as soon as your payment completes. There is no approval step and nothing to wait for.

Prices, GST and billing

• Prices are shown excluding GST. New Zealand GST is added at checkout, so a $49 monthly placement is charged at $56.35 and a $490 annual placement at $563.50.
• Payments are handled by Stripe. We never see or hold your card details.
• Monthly placements renew automatically each month until you cancel. Cancel any time and your placement runs to the end of the period you have already paid for.
• Annual placements are prepaid for 12 months and are not refundable part way through. You can cancel renewal at any time, so you are never locked in beyond the year you have paid for.
• We may change our prices. A change never affects a period you have already paid for, and we will tell you before a renewal at a new price.

Cancelling

Cancel yourself in the Stripe billing portal, using the link in your Stripe receipt email, or email topchoice@eightysix.digital and we will do it for you. When a placement ends, your card comes off the page and the spot becomes available to someone else.

The content you give us

• You confirm that your business details are accurate, that you are authorised to buy a placement for that business, and that the description you supply is your own to use.
• We may edit your description for length, spelling or house style. We will not change what it says about your business.
• Keep your details current. If your phone number or website changes, email us and we will update the card.

Declining, suspending and removing placements

• We may decline, suspend or remove a placement at our discretion, for example where a business is not genuinely operating in that location, where the details are inaccurate or misleading, or where we receive credible complaints about the business.
• If we remove a placement for a reason other than a breach of these terms, we will refund the unused part of the period you have paid for.
• If we remove a placement because of a breach, no refund is due.

Spotlight and the Top 5 are separate

Paying for a Spotlight placement does not get you into the Top 5, and it does not keep you out of it. Our Top 5 is chosen through our own research and is not for sale. A Spotlight business can also appear in the Top 5 on the same page, but only when it earns that place on merit.

What we can and cannot promise

We put your business in front of people looking for your trade in your area. We cannot promise a number of enquiries, calls or jobs, and nothing on this site should be read as guaranteeing any particular result. Our liability to you is limited to the amount you have paid us for the placement in the 12 months before the issue arose. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those apply.

Business profiles

A business profile page is a separate service that we set up by hand, and it is not included in a Spotlight placement. A profile stays live if a Spotlight placement ends. Email us if you would like one.

Changes to these terms

We may update these terms. The date at the top of this page tells you when they last changed. If we make a change that materially affects a live placement, we will email the business concerned.
